Terms and Conditions of the Online Store

§1 General Provisions

  1. These Terms and Conditions govern the use of the online store available at https://www.safeandsound.pl/, the placing of orders, the conclusion of sales contracts, payments, delivery of goods, withdrawal from the contract, and the submission of complaints.

  2. The seller and owner of the Store is Safe and Sound - Paweł Kostrzewa, Bukowa 1, 05-800 Pruszków, Poland, Tax Identification Number (NIP): 5342264118, phone: +48 501 352 499, e-mail: kontakt@safeandsound.pl, hereinafter referred to as the “Seller”.

  3. These Terms apply to both Consumers and Business Customers.

  4. For the purposes of these Terms:
    a) “Consumer” means a natural person acting for purposes outside their trade, business or profession;
    b) “Business Customer” means a person or entity acting for purposes related to their trade, business or profession;
    c) where applicable under Polish law, certain sole traders may also benefit from consumer protection rights.

  5. Acceptance of these Terms is a condition for placing an order and concluding a sales contract.

  6. All prices shown in the Store are gross prices and include applicable taxes, unless explicitly stated otherwise.

  7. Information presented in the Store, including product descriptions, photographs and prices, constitutes an invitation to enter into a contract and not a binding offer, unless mandatory law provides otherwise.

  8. The Seller undertakes to deliver goods in conformity with the contract and free from legal defects.

  9. Nothing in these Terms excludes or limits any statutory rights granted to Consumers under applicable law.

§2 Orders and Conclusion of the Contract

  1. Orders may be placed:
    a) via the order form available on the Store’s website,
    b) by e-mail to: kontakt@safeandsound.pl,
    c) by phone at: +48 501 352 499.

  2. In order to place an order, the Customer must provide accurate data necessary for order verification and delivery, including in particular their name, delivery address, e-mail address and, where required, phone number.

  3. In the case of orders placed through the website, the sales contract is concluded when the Customer receives an e-mail confirming that the order has been accepted for processing.

  4. In the case of orders placed by e-mail, the sales contract is concluded when the Seller confirms acceptance of the order for processing.

  5. In the case of Consumer orders placed by telephone, the Seller shall confirm the proposed contract terms on a durable medium where required by applicable law. The contract shall be concluded once the Consumer confirms acceptance in the manner required by applicable law.

  6. After the contract is concluded, the Seller shall provide the Customer with confirmation of the contract terms on a durable medium, in particular by e-mail.

  7. The Customer is obliged to use the Store in a lawful manner and in accordance with these Terms.

§3 Prices, Payment and Delivery Costs

  1. Available payment methods are described on the Payment Methods page and are also presented during the checkout process.

  2. The Customer is obliged to make payment within the time specified during the order process or individually agreed with the Seller.

  3. If electronic payments or card payments are available, they may be processed by external payment service providers.

  4. Delivery costs are shown to the Customer before the order is placed and are also described on the Delivery Policy page.

  5. Information on any delivery restrictions and accepted payment methods is provided in the Store before the Customer places an order.

§4 Order Processing and Delivery

  1. The average order processing time is 2–3 business days from:
    a) the date the payment is credited to the Seller’s account, for prepaid orders, or
    b) the date the order is accepted for processing, if cash on delivery is available.

  2. In exceptional cases, including out-of-stock products, made-to-order or personalised products, or unusually large orders, the processing time may be extended. In such cases the Customer will be informed without undue delay.

  3. Delivery is made to the address provided by the Customer when placing the order.

§5 Complaints and Seller’s Liability for Lack of Conformity

  1. The Seller is liable to Consumers for any lack of conformity of the goods with the contract, in accordance with applicable law.

  2. The Seller shall be liable for any lack of conformity that exists at the time of delivery and becomes apparent within 2 years from delivery, unless the mandatory law applicable to the Consumer provides a longer period.

  3. Complaints may be submitted:
    a) by e-mail to: kontakt@safeandsound.pl,
    b) by post to: Safe and Sound - Paweł Kostrzewa, Bukowa 1, 05-800 Pruszków, Poland.

  4. In order to help us process the complaint more efficiently, the Customer should provide the order number, a description of the issue and, where possible, photographs. Failure to provide this information does not prevent the complaint from being submitted.

  5. If the goods are not in conformity with the contract, the Customer may request repair or replacement and, in cases provided by applicable law, may also request a price reduction or withdraw from the contract.

  6. The Seller shall respond to the complaint within 14 days of receipt.

§6 Right of Withdrawal

  1. A Consumer, and where applicable a sole trader entitled to consumer protection under Polish law, has the right to withdraw from a distance contract without giving any reason within 14 days from the day they receive the goods.

  2. To exercise the right of withdrawal, the Customer must send a clear statement of withdrawal:
    a) by e-mail to: kontakt@safeandsound.pl, or
    b) by post to: Safe and Sound - Paweł Kostrzewa, Bukowa 1, 05-800 Pruszków, Poland.

  3. To meet the withdrawal deadline, it is sufficient for the Customer to send the withdrawal statement before the deadline expires.

  4. The goods must be returned without undue delay and no later than 14 days from the date on which the Customer informed the Seller of the withdrawal.

  5. The Customer bears the direct cost of returning the goods, unless the Seller has agreed to bear that cost or failed to inform the Customer of that obligation before the purchase.

  6. The Seller shall refund all payments received from the Customer, including the cost of the least expensive standard delivery method offered by the Store, without undue delay and no later than 14 days from the day the Seller receives the withdrawal statement. The Seller may withhold the refund until the goods are received back or the Customer provides proof of return, whichever occurs first. Refunds shall be made using the same payment method used by the Customer, unless the Customer expressly agrees otherwise and incurs no additional cost.

  7. The right of withdrawal does not apply where excluded by applicable law, in particular in relation to goods made to the Customer’s specifications or clearly personalised goods.

§7 Personal Data

  2. Personal data is processed in accordance with applicable law, including Regulation (EU) 2016/679 (GDPR) and other applicable data protection laws.

§8 Intellectual Property

  1. All content available in the Store, including texts, photographs, graphics, trademarks, layout and other materials, is protected by law.

  2. Any use, copying, modification or distribution of such content without prior consent of the Seller or other authorised right holder is prohibited, except where permitted by law.

§9 Governing Law and Dispute Resolution

  1. These Terms are governed by Polish law.

  2. In relation to Consumers, the choice of Polish law shall not deprive the Consumer of the protection granted by mandatory provisions of the law of the country of the Consumer’s habitual residence.

  3. Consumers may use out-of-court complaint and redress mechanisms where available under applicable law.

  4. Any disputes involving Consumers shall be resolved by the courts having jurisdiction under applicable law.

  5. Any disputes involving Business Customers shall be resolved by the courts having jurisdiction in Poland.

§10 Business Customer Provisions

  1. This section applies only to Business Customers who do not benefit from consumer protection under applicable law.

  2. The right of withdrawal from a distance contract does not apply to Business Customers, unless mandatory law provides otherwise.

  3. To the fullest extent permitted by law, the Seller’s liability under statutory warranty rules towards Business Customers is excluded.

  4. To the fullest extent permitted by law, the Seller shall not be liable to Business Customers for loss of profit or indirect damages.

§11 Final Provisions

  1. In matters not regulated by these Terms, the applicable provisions of Polish law and, where applicable, mandatory consumer protection rules shall apply.

  2. These Terms enter into force on [date].

  3. The version of the Terms in force at the time the contract is concluded shall apply to orders placed before any amendment.
